Welcome to NearMe Kitchen & Bath ("we," "us," or "our"). These Terms of Service govern your use of our website at www.nearmekitchenbath.com (including EZ Price, Price Match, Shop, and Customer Portal) and our kitchen and bathroom remodeling services.

By accessing our site, requesting quotes, or engaging our design and installation services, you agree to these terms. If you do not agree, please do not use our services.

1 Services Overview

NearMe Kitchen & Bath provides residential kitchen and bathroom renovation services guided by our N.E.A.R M.E. principles:

  • Artistry: Craft and attention to detail that transforms spaces
  • Renovation: Comprehensive service from first sketch to final installation
  • Mastery: Deep expertise in regional design, codes, and architectural styles
  • Elegance: Timeless aesthetics honoring both heritage and contemporary living
Service Area: Our installation services are available within Pennsylvania, New Jersey, Maryland, Washington D.C., and Northern Virginia. Product-only sales may be available outside this area subject to shipping terms.

2 Design & Measurement Services

A. Kitchen Layout Design

Initial Design Consultation: Kitchen layout design services are complimentary and provided at no charge during the consultation process.

Design Documentation Fee: If customer requests to print or take physical/digital copies of the designer's layout drawings, plans, or specifications off-site, a $150 documentation fee is required prior to release.

Fee Application:
If Order is Placed: The $150 fee converts to a deposit and is fully credited toward the total kitchen cabinetry purchase price.
If Order is NOT Placed: The $150 fee is non-refundable and forfeited to cover design consultation, drafting, and administrative costs. No exceptions.

B. Countertop Measurement & Template

Pre-Payment Required: A $150 measurement and template fee must be paid in full prior to scheduling any on-site measurement appointment. No measurement will be conducted without advance payment.

Accepted Payment Methods for Measurement Fee: Cashier's Check, Money Order, Cash, or Credit Card (same as Section 3).

Fee Application:
If Order is Placed: The $150 fee converts to a deposit and is fully credited toward the countertop purchase price.
If Order is NOT Placed: The $150 fee is non-refundable and forfeited to cover measurement, template creation, and processing costs. No exceptions.

On-Site Communication: Customer must be present during measurement to communicate all specifications directly with the technician (edge profiles, cutouts, seam placement, backsplash, etc.). Requirements not confirmed on-site will not be included.

No Modifications After Order: Once the countertop order is placed and the template is created, no modifications are permitted under any circumstances. This includes dimensions, edge profiles, color, material, cutout locations, or seam placement. Customer is responsible for verifying all details before signing the final order confirmation. Errors due to customer failure to review specifications are not grounds for cancellation, modification, or refund.

3 Orders & Payment Policy

FULL PAYMENT REQUIRED: All orders require 100% full payment at the time of order placement. No exceptions. We do not accept partial deposits or payment plans for product orders.

  • Personal Checks (No exceptions)
  • Business Checks (No exceptions)
  • Payment plans or partial deposits
  • Third-party financing (unless pre-approved)

Pre-Delivery Payment Verification

  • No Payment = No Delivery: Delivery will not be scheduled until full payment has been received and verified in our account
  • Credit Card Verification: Card payments are subject to anti-fraud review and may require additional verification. Orders will not ship until verification is complete
  • Payment Default: If full payment is not received by the scheduled delivery date, delivery will be automatically cancelled. Customer will be responsible for all costs associated with rescheduling, including storage fees, redelivery charges, and any price adjustments due to material cost increases

Rescheduling & Failed Delivery Costs

  • Orders without cleared payment at delivery time will be returned to warehouse
  • Storage fees will apply starting from the original delivery date
  • Redelivery fees must be paid in advance to reschedule
  • Customer responsible for any material price increases between original and rescheduled dates
  • After multiple failed delivery attempts, order may be cancelled with applicable restocking fees

4 Shipping & Delivery

Mandatory Adult Presence Required

ABSOLUTE REQUIREMENT: An authorized adult aged 18 years or older MUST be present at the delivery location throughout the entire delivery window to inspect and sign for the goods. NO EXCEPTIONS.

If No Adult (18+) Present:

  • Items will NOT be left unattended under any circumstances
  • Delivery will be immediately rescheduled
  • Customer will be charged applicable rescheduling and storage fees
  • Customer will be responsible for any material price increases between original and rescheduled dates
  • After multiple failed delivery attempts, order may be cancelled with applicable restocking fees

Delivery Scope & Limitations

  • Sidewalk/Curbside Only: Our team delivers to sidewalk or curbside only. We do not carry items inside residences, garages, or buildings. Customer must move items from delivery point to desired location
  • Accessibility: Customer must ensure adequate space for truck access and unloading. Narrow streets, steep driveways, or stairs must be disclosed prior to delivery
  • Inspection Before Signing: The authorized adult (18+) must inspect all items BEFORE signing the delivery receipt. Any damage, defects, or missing items must be clearly noted on the receipt immediately. Claims for damage or missing items will NOT be accepted after signature has been obtained
  • Damage Reporting: Hidden defects or missing items must be reported within 48 hours with photographic evidence. Claims not noted on delivery receipt at time of signature will not be honored

5 Digital Services & User Responsibilities

  • Account Security: You are responsible for maintaining the confidentiality of your account information, including passwords. Notify us immediately of any unauthorized access
  • Accurate Information: You must provide current, complete, and accurate account and contact information for all purchases
  • Age Requirement: You must be 18 or older to create accounts or submit orders
  • Prohibited Activities: You agree not to use bots, scrapers, or automated tools on our EZ Price or Quote systems, or engage in any activity that disrupts or interferes with our services
  • Suspension: We may suspend accounts for suspicious activity, security breaches, or terms violations

6 Returns, Cancellations & Refunds

SPECIAL ORDERS — FINAL SALE:
Special Orders are NON-CANCELLABLE and NON-REFUNDABLE. Once a special order is placed and processed, it cannot be cancelled, modified, or returned under any circumstances. This includes non-standard sizes, custom colors, imported materials, or any items not part of our standard stock inventory. By placing a special order, customer acknowledges these items are manufactured specifically for their project and cannot be resold.

Stock Items

Stock items may be returned subject to a 25% restocking fee. Items must be in original, unopened packaging, unused, and in resalable condition. Original delivery fees are non-refundable under any circumstances.

Non-Returnable Items (No Exceptions)

  • Special orders and custom-made products
  • Items assembled, modified, cut, drilled, or altered
  • Clearance/discontinued items
  • Items without original packaging
  • Design documentation or measurement fees (if order not placed)

Damaged or Defective Items

  • Shipping Damage: Must be reported within 48 hours of delivery with photographic evidence of the damage and packaging
  • Manufacturer Defects: Must be reported within 48 hours of delivery. We will coordinate with manufacturers for repair or replacement at their discretion
  • Wrong Items: If we ship incorrect items, we will arrange return shipping and send correct items at no additional cost
