Welcome to NEARME Kitchen & Bath ("NEARME," "we," "us," or "our"). These Terms of Service govern your use of our website at www.nearmekitchenbath.com, including our online shop, EZ Price, Price Match, customer portal, quotes, online product purchases, payments, delivery, pickup, returns, exchanges, refunds, chargebacks, and related customer service matters.

Online Seller / Merchant of Record: All online shop and e-commerce sales made through this website are sold by NEARME Kitchen & Bath. NEARME Kitchen & Bath is the seller, merchant of record, and contracting party for all online product purchases, payments, deliveries, pickups, returns, exchanges, refunds, payment disputes, chargebacks, and related customer service matters.

By accessing our site, creating an account, requesting a quote, placing an online order, submitting payment, accepting delivery or pickup, or using our online services, customer agrees that the transaction is made with NEARME Kitchen & Bath and is governed by these Terms of Service.

Nothing in these Terms is intended to limit any rights that cannot be limited under applicable law. Where a term is prohibited by law, that term will apply only to the maximum extent permitted.

1 Services Overview

NEARME Kitchen & Bath provides online product sales, design-related support, quote support, customer portal access, and related kitchen and bath product services through this website.

Products and services may include kitchen cabinets, bathroom vanities, countertops, flooring, tile, backsplash materials, cabinet samples, hardware, accessories, design support, measurement-related services, and order coordination.

Product Sales vs. Installation: Online product purchases do not include installation, remodeling labor, plumbing, electrical work, permit work, demolition, hauling, or contractor services unless expressly stated in a separate written agreement signed by NEARME Kitchen & Bath.
Service Area: Delivery, pickup, showroom support, measurement, and installation-related services, when available, may be limited to Pennsylvania, New Jersey, Maryland, Washington D.C., and Northern Virginia. Product-only sales may be available outside this area subject to shipping, supplier, and carrier limitations.

2 Design & Measurement Services

A. Kitchen Layout Design

Initial Design Consultation: Kitchen layout design consultation may be provided at no charge during the initial consultation process.

Design Documentation Fee: If customer requests to print, download, email, export, or take physical/digital copies of the designer's layout drawings, plans, renderings, item lists, or specifications off-site, a $150 documentation fee is required prior to release.

Fee Application:
If Order is Placed: The $150 fee converts to a deposit and is credited toward the applicable kitchen cabinetry purchase price.
If Order is NOT Placed: The $150 fee is non-refundable and forfeited to cover design consultation, drafting, and administrative costs. No exceptions.

B. Countertop Measurement & Template

Pre-Payment Required: A $150 measurement and template fee must be paid in full prior to scheduling any on-site measurement appointment. No measurement will be conducted without advance payment.

Accepted Payment Methods for Measurement Fee: Online payment, cashier's check, money order, cash, or credit/debit card, subject to the payment rules in these Terms.

Fee Application:
If Order is Placed: The $150 fee converts to a deposit and is credited toward the applicable countertop purchase price.
If Order is NOT Placed: The $150 fee is non-refundable and forfeited to cover measurement, template creation, travel, and processing costs. No exceptions.

On-Site Communication: Customer or an authorized adult decision-maker must be present during measurement to communicate and confirm all specifications directly with the technician, including edge profiles, cutouts, sink type, faucet holes, seam placement, backsplash, overhang, appliance information, wall conditions, cabinet support, and any special requirements. Requirements not confirmed on-site may not be included.

No Modifications After Countertop Order: Once the countertop order is placed, template is created, material is reserved, or fabrication has begun, no modifications are permitted under any circumstances. This includes dimensions, edge profiles, color, material, cutout locations, sink selection, faucet holes, overhang, backsplash, or seam placement. Customer is responsible for verifying all details before signing or approving the final order confirmation. Errors due to customer failure to review specifications are not grounds for cancellation, modification, or refund.

C. Customer-Provided Measurements

For online, product-only, or customer-measured orders, customer is solely responsible for all measurements, appliance specifications, site conditions, clearances, walls, ceilings, floors, openings, plumbing, electrical, and layout decisions. NEARME Kitchen & Bath is not responsible for fit issues, measurement errors, appliance conflicts, installation conflicts, field conditions, or additional labor/material costs caused by customer-provided measurements or information.

3 Quotes, Pricing & Availability

Quotes are estimates only and are valid for the period stated on the quote. If no expiration date is stated, quotes are valid for seven (7) days from the quote date.

Prices Subject to Change: Prices, taxes, shipping, freight, tariffs, supplier fees, availability, specifications, product images, lead times, and promotions are subject to change until the order is fully paid, accepted, and processed by NEARME Kitchen & Bath and/or the applicable supplier.

Typographical errors, pricing errors, product information errors, website errors, inventory errors, tax calculation errors, or supplier data errors may be corrected at any time. We reserve the right to cancel, reject, refund, or revise any order affected by an error, even after payment, to the extent permitted by law.

Product images, samples, website photos, renderings, and descriptions are for general reference only. Final products may vary due to manufacturer specifications, production batches, lighting, screen settings, natural material characteristics, and supplier updates.

4 Orders & Payment Policy

FULL PAYMENT REQUIRED: All online shop and product orders require 100% full payment at the time of order placement unless otherwise stated in writing by NEARME Kitchen & Bath. We do not accept partial deposits or payment plans for product orders unless separately approved in writing.

Payment Verification

  • No Cleared Payment = No Order Processing: Orders may not be submitted to suppliers, released, shipped, scheduled for pickup, or delivered until full payment has been received, cleared, and verified.
  • Anti-Fraud Review: Card and online payments are subject to anti-fraud review and may require additional verification, valid ID, billing address confirmation, phone/email confirmation, or other reasonable verification.
  • Order Hold: We may place an order on hold, cancel an order, or request another payment method if payment is declined, flagged, reversed, disputed, suspicious, or unverifiable.
  • Payment Default: If full payment is not received or cleared by the scheduled delivery/pickup date, delivery or pickup may be cancelled. Customer is responsible for all related rescheduling, storage, freight, redelivery, supplier, and handling fees.

5 Customer Order Approval

Customer Must Review Before Payment: Customer is responsible for reviewing and approving all product and order details before payment and order submission, including but not limited to product name, SKU, color, finish, size, quantity, cabinet type, hinge side, door swing, accessories, panels, fillers, moldings, layout, measurements, appliance specifications, delivery address, contact information, and special notes.

Once an order is approved, paid, and processed, NEARME Kitchen & Bath is not responsible for customer-approved errors, omissions, measurement mistakes, wrong color selections, wrong quantities, wrong sizes, wrong accessories, appliance fit issues, or changes requested after processing.

Customer acknowledges that cabinets, countertops, flooring, tile, and other kitchen/bath materials may require professional review and field verification before ordering. Customer is responsible for ensuring that all products ordered are suitable for the project, site conditions, building conditions, and installation plan.

6 Shipping, Pickup & Delivery

Mandatory Adult Presence Required

ABSOLUTE REQUIREMENT: An authorized adult aged 18 years or older MUST be present at the delivery location throughout the entire delivery window to inspect and sign for the goods. NO EXCEPTIONS.

If No Adult (18+) Is Present:

  • Items will not be left unattended unless separately approved in writing
  • Delivery may be immediately rescheduled or returned to warehouse/carrier
  • Customer will be charged applicable rescheduling, redelivery, freight, handling, and storage fees
  • Customer will be responsible for any material price increases, supplier fees, or carrier fees between original and rescheduled dates
  • After multiple failed delivery attempts, order may be cancelled or returned to supplier/stock with applicable restocking, freight, storage, and handling fees

Delivery Scope & Limitations

  • Sidewalk/Curbside Only: Standard delivery is sidewalk/curbside only. We do not carry items inside residences, garages, basements, elevators, apartments, job sites, or buildings unless a separate written service is approved.
  • Customer Moves Items: Customer is responsible for moving items from the delivery point to the desired location and for providing sufficient labor, equipment, and safe access.
  • Site Accessibility: Customer must ensure adequate truck access, unloading area, parking, driveway access, street access, and safe conditions. Narrow streets, steep driveways, stairs, low wires, restricted access, parking limitations, or unsafe conditions must be disclosed before delivery.
  • Delivery Window: Delivery dates and times are estimates only and may be affected by supplier delays, carrier delays, traffic, weather, warehouse schedules, or other circumstances outside our control.

Pickup Orders

For pickup orders, customer is responsible for inspecting all items at pickup, loading the items safely, securing the load, and transporting the items. Risk of damage after pickup transfers to customer once items are released to customer or customer’s representative/carrier.

7 Inspection, Damage Claims & Missing Items

Inspect Before Signing

Inspection Required Before Signature: The authorized adult must inspect all items before signing the delivery receipt, bill of lading, pickup receipt, or carrier paperwork. Any visible damage, shortage, missing item, wrong item, or packaging issue must be clearly written on the receipt immediately.
  • Claims for visible damage, shortage, or missing items may be denied if not noted on the delivery/pickup receipt at the time of signature.
  • Hidden defects or concealed damage must be reported within 48 hours of delivery or pickup with clear photos of the item, packaging, label, SKU, and order information.
  • Customer must keep all original packaging, boxes, labels, pallets, and damaged items until the claim is fully resolved.
  • Manufacturer or carrier approval may be required before replacement, credit, refund, or repair is issued.
Do Not Install Damaged or Incorrect Items: Customer must not install, assemble, modify, cut, drill, glue, fasten, paint, dispose of packaging, or otherwise alter any item that appears damaged, defective, incorrect, incomplete, or questionable. Installation or modification of an item is considered acceptance of that item and may void return, replacement, damage claim, or warranty rights.

NEARME Kitchen & Bath is not responsible for damage caused after delivery or pickup, including damage caused by customer handling, customer transportation, storage, weather exposure, job site conditions, moisture, heat, improper stacking, improper installation, contractor handling, or misuse.

8 Returns, Exchanges, Cancellations & Refunds

SPECIAL ORDERS — FINAL SALE:
Special Orders are NON-CANCELLABLE and NON-REFUNDABLE once processed. Once a special order is placed, submitted, reserved, manufactured, fabricated, assembled, modified, palletized, shipped, or otherwise processed, it cannot be cancelled, modified, exchanged, or returned under any circumstances except where required by law or approved in writing by NEARME Kitchen & Bath.

Special Orders include, but are not limited to: cabinets, countertops, vanities, flooring, tile, backsplash materials, custom-size items, modified items, assembled items, cut items, drilled items, fabricated items, non-stock items, imported materials, non-standard colors, special finishes, clearance/discontinued items, parts, doors, drawers, panels, moldings, hardware, accessories, and any items ordered from suppliers specifically for the customer.

Stock / Eligible Items

Eligible return or exchange requests must be made within four (4) weeks of delivery or customer pickup. Items must be unused, unopened, uninstalled, unassembled, undamaged, and in the original packaging. All returns and exchanges are subject to manual review and approval by NEARME Kitchen & Bath. Approval is not guaranteed.

Approved returns are subject to a 25% restocking fee. Original delivery, shipping, pickup, handling, service, measurement, design, credit card processing, and other non-product fees are non-refundable. Customer is responsible for return transportation, return freight, packaging, and any supplier/carrier charges unless otherwise agreed in writing.

Non-Returnable Items — No Exceptions

  • Special orders and custom-made products
  • Countertops, fabricated surfaces, cut materials, or templated items
  • Assembled, installed, modified, cut, drilled, glued, painted, altered, or used items
  • Opened items or items without original packaging
  • Damaged items not reported according to these Terms
  • Clearance, discontinued, final sale, or closeout items
  • Parts, doors, drawers, panels, trim, moldings, fillers, hardware, accessories, samples, and replacement components
  • Design documentation, measurement, template, delivery, pickup, handling, service, or administrative fees
  • Items not in resalable condition

Refund Processing

Approved refunds or credits will be processed only after the returned merchandise is received, inspected, and approved. Refunds may be reduced by restocking fees, freight, storage, handling, supplier fees, damage, missing packaging, missing parts, or other applicable charges. Refund timing may vary based on payment method, bank, processor, supplier, and inspection process.

Cancellation After Processing

If a cancellation is requested after an order has been processed but before delivery or pickup, approval is not guaranteed. If approved, cancellation may be subject to supplier cancellation fees, restocking fees, freight, handling, storage, and any other costs already incurred.

9 Installation & Contractor Responsibility

Installation Not Included Unless Written: Unless stated in a separate written installation agreement signed by NEARME Kitchen & Bath, product purchases do not include installation or remodeling labor.

NEARME Kitchen & Bath is not responsible for installer workmanship, contractor scheduling, job site supervision, demolition, plumbing, electrical work, HVAC, wall conditions, floor levelness, ceiling height, appliance fitment, countertop support, cabinet installation, tile installation, flooring installation, code compliance, permits, inspections, or any labor costs related to installation, removal, reinstallation, adjustment, repair, or project delays.

Customer and/or customer’s contractor is responsible for confirming that all site conditions are suitable before installation, including wall strength, floor levelness, moisture, humidity, cabinet support, appliance clearances, plumbing/electrical locations, door swings, filler requirements, and local code requirements.

Labor Costs Not Covered: Product replacement, warranty approval, or damaged-item resolution does not include labor, installation, removal, reinstallation, project delay, contractor fees, lost time, or other incidental costs unless required by law or expressly agreed in writing.

10 Color, Finish & Material Variation

Natural & Manufacturing Variations: Customer understands that cabinet finishes, wood grain, paint, stain, countertop slabs, quartz, stone, flooring, tile, backsplash, hardware, and other materials may vary from samples, showroom displays, printed materials, website images, photos, renderings, previous orders, or replacement parts.

Natural variations, lighting differences, screen settings, dye lots, production batches, supplier updates, manufacturer tolerances, wood characteristics, grain patterns, knots, mineral marks, veining, shade variation, gloss variation, texture variation, and material characteristics are not considered defects.

Customer is responsible for reviewing physical samples, supplier samples, slab selections, tile lots, flooring lots, and final specifications before ordering when exact color/finish matching is important. Exact matching between different materials, batches, brands, rooms, or order dates is not guaranteed.

11 Manufacturer Warranty

Product warranties, if any, are provided by the manufacturer and are subject to the manufacturer’s warranty terms, exclusions, approval process, and remedy decisions. NEARME Kitchen & Bath does not provide any additional product warranty unless stated in writing.

Warranty Exclusions: Warranty coverage does not include labor, installation, removal, reinstallation, delivery, freight, service calls, contractor fees, project delays, lost time, temporary housing, lost profits, or incidental/consequential costs.

Warranty claims may be denied for improper installation, misuse, abuse, neglect, job site damage, moisture exposure, excessive heat, improper cleaning, improper storage, modification, cutting, drilling, painting, improper handling, failure to follow manufacturer care instructions, normal wear and tear, or installation of damaged/incorrect items.

12 Storage, Delayed Pickup & Abandoned Orders

Customer must accept delivery or pick up the order within the scheduled time period. If customer delays, misses, refuses, or fails to accept delivery or pickup, storage fees, redelivery fees, handling fees, supplier fees, and carrier charges may apply.

Abandoned Orders: Orders not picked up or accepted within thirty (30) days after notice of availability may be treated as abandoned and may be returned to stock, returned to supplier, resold, disposed of, or cancelled, subject to applicable restocking, storage, freight, supplier, and handling fees.

Customer remains responsible for any unpaid balance, storage fees, redelivery fees, return freight, restocking fees, supplier charges, collection costs, and other costs caused by delayed pickup, missed delivery, refusal, or abandonment.

13 Payment Disputes & Chargebacks

Customer agrees to contact NEARME Kitchen & Bath in writing at nearmekb@gmail.com to resolve any order, delivery, damage, missing item, return, exchange, refund, or billing issue before initiating a payment dispute or chargeback.

Improper Chargebacks: If a chargeback, payment dispute, or reversal is determined to be improper, fraudulent, or inconsistent with these Terms, customer is responsible for the disputed amount, chargeback fees, payment processor fees, collection costs, storage fees, return freight, and reasonable legal fees where permitted by law.

Customer authorizes NEARME Kitchen & Bath to provide order records, delivery receipts, pickup receipts, signatures, photos, emails, text messages, invoices, terms acceptance records, and other relevant evidence to payment processors, banks, card networks, carriers, suppliers, or collection parties to resolve payment disputes.

14 Digital Services & User Responsibilities

  • Account Security: Customer is responsible for maintaining the confidentiality of account information, passwords, and login access. Notify us immediately of any unauthorized access.
  • Accurate Information: Customer must provide current, complete, and accurate contact information, billing information, shipping information, measurements, product selections, and project details.
  • Age Requirement: Customer must be 18 or older to create accounts, place orders, submit payments, or agree to these Terms.
  • Prohibited Activities: Customer agrees not to use bots, scrapers, automated tools, unauthorized access methods, reverse engineering, fraudulent payment methods, or any activity that disrupts or interferes with our website, EZ Price, Quote systems, Shop, or Customer Portal.
  • Suspension: We may suspend or restrict accounts for suspicious activity, security risks, payment issues, fraud concerns, or Terms violations.

15 Limitation of Liability

Limited Liability: To the maximum extent permitted by law, NEARME Kitchen & Bath is not liable for indirect, incidental, special, punitive, exemplary, or consequential damages, including but not limited to installation costs, removal costs, reinstallation costs, contractor fees, project delays, lost profits, lost time, business interruption, temporary housing, storage costs, financing costs, or emotional distress.

To the maximum extent permitted by law, NEARME Kitchen & Bath’s maximum liability for any claim related to a product, order, delivery, pickup, return, exchange, refund, warranty, website use, quote, or service is limited to the amount customer paid to NEARME Kitchen & Bath for the specific product or service giving rise to the claim.

Customer agrees that product replacement, repair, store credit, or refund, if approved, is the exclusive remedy for covered product issues, subject to these Terms and applicable manufacturer policies.

16 Lead Times, Delays & Force Majeure

Lead times, delivery dates, pickup dates, production dates, and installation-related dates are estimates only and are not guaranteed. Delays may occur due to supplier delays, backorders, discontinued products, trucking delays, weather, labor shortages, customs, tariffs, manufacturing issues, payment verification, customer-caused delays, site conditions, permit issues, or circumstances outside our control.

No Delay Damages: NEARME Kitchen & Bath is not responsible for project delay damages, contractor delay fees, lost time, lost income, temporary housing, storage, or other incidental/consequential damages caused by product delays, delivery delays, supplier delays, or force majeure events.

We may substitute, cancel, refund, or revise an order if a product becomes unavailable, discontinued, materially delayed, incorrectly listed, or impossible to fulfill under commercially reasonable terms.

17 Taxes, Fees & Compliance

Customer is responsible for applicable sales tax, use tax, delivery fees, shipping fees, freight, tariffs, handling fees, storage fees, service fees, and other charges associated with the order unless otherwise stated in writing.

Tax calculations may depend on delivery location, pickup location, product type, customer status, and applicable law. If tax or fee calculations are incorrect due to system error, customer information error, exemption documentation issue, or legal requirement, we reserve the right to correct the amount before or after order processing to the extent permitted by law.

Customer is responsible for providing valid and complete resale certificates, exemption certificates, or other tax documentation before order processing if claiming tax exemption. Tax exemption is not guaranteed and may be denied if documentation is incomplete, invalid, expired, or not accepted.

18 Governing Law & Disputes

These Terms and online transactions with NEARME Kitchen & Bath are governed by the laws of the Commonwealth of Pennsylvania, except where prohibited by applicable law. Any dispute shall be handled in a court or venue permitted by applicable law.

Before filing a claim, customer agrees to contact NEARME Kitchen & Bath in writing at nearmekb@gmail.com and provide a reasonable opportunity to review and resolve the issue.

This section does not limit any non-waivable consumer rights under applicable state or federal law.

19 Updates to These Terms

We may update these Terms from time to time. The version posted on www.nearmekitchenbath.com at the time of order placement, payment, delivery, pickup, or service request will apply to that transaction unless otherwise required by law.

Customer is responsible for reviewing the Terms before placing an order or submitting payment. Continued use of the website, online shop, customer portal, or services after updates means customer accepts the updated Terms.

20 Customer Acknowledgment

By placing an online order, submitting payment, accepting delivery or pickup, signing a receipt, or checking the Terms acceptance box at checkout, customer acknowledges and agrees that:
  1. All online shop sales are made through NEARME Kitchen & Bath.
  2. Customer has reviewed and approved all product details, quantities, colors, sizes, measurements, delivery information, and order specifications before payment.
  3. Full payment is required before order processing, delivery, pickup, or release of goods.
  4. Special orders, countertops, custom items, modified items, and supplier-ordered items are final sale once processed.
  5. Eligible returns or exchanges must be requested within four (4) weeks and are subject to manual approval, unopened/unused/uninstalled condition, original packaging, and a 25% restocking fee.
  6. An adult aged 18 or older must be present for delivery, inspect items before signing, and note visible damage or missing items on the receipt.
  7. Hidden damage or concealed defects must be reported within 48 hours with photos and original packaging.
  8. Damaged, incorrect, or questionable items must not be installed, assembled, modified, cut, drilled, or altered.
  9. Installation, labor, removal, reinstallation, contractor fees, project delays, and incidental costs are not covered unless separately agreed in writing.
  10. Customer agrees to all payment, delivery, inspection, cancellation, return, exchange, restocking fee, warranty, chargeback, and liability policies stated in these Terms.
